Speed to lead is the time between a new inquiry and your first real reply. Answer within minutes, by the channel the person used, and you talk to them while they are still choosing. Do it by text only when you have their consent, and stop the moment they ask, because the US rules on that are strict and they change again on November 25, 2026.
Why minutes matter more than polish
Buyers who fill in a form are usually comparing options. The first business that answers with something useful sets the terms of the conversation. Research published in Harvard Business Review in 2011 by James Oldroyd, Kristina McElheran and David Elkington found that most companies answered online leads far too slowly, and that the chance of reaching and qualifying a lead dropped sharply within the first hour.
The fix is rarely more salespeople. It is a system that answers every inquiry the same way, at any hour, and hands a warm conversation to a person.
- Second 0: the inquiry arrives from a form, a call, a chat or a text message, and lands on one contact record.
- Under a minute: an acknowledgment goes out on the same channel, with a link to book a time.
- Minutes 1 to 5: an AI agent or a person asks one or two qualifying questions and offers times.
- Booked: the meeting is confirmed with reminders by email and, with consent, by text.
- Not booked: the inquiry moves into a short follow-up sequence and a named owner gets a task.
The consent rules for calls and texts
The Telephone Consumer Protection Act rules sit in the FCC's regulations at 47 CFR 64.1200. Four points shape every automated reply.
| Rule | What it means for an automated reply |
|---|---|
| Prior express written consent | Needed before marketing calls or texts sent with automated technology. Put clear consent wording next to the phone field on your forms. |
| Quiet hours | Telephone solicitations may not be made before 8 am or after 9 pm in the recipient's local time. |
| National Do Not Call Registry | Telephone solicitations may not go to numbers on the registry unless an exemption applies, such as an existing business relationship or permission. |
| Revoking consent | Requests made in any reasonable way must be honored within a reasonable time, no more than ten business days. |
The carriers add their own layer. The CTIA's Messaging Principles and Best Practices expect clear sign-up, an identified sender and an easy way out, and business texting from local numbers has to be registered under 10DLC. Our post on WhatsApp and text messaging for business covers that registration and its cost.
What changes on November 25, 2026
On October 26, 2026, the FCC published a final rule in the Federal Register on how people revoke consent to calls and texts. It takes effect on November 25, 2026. Three changes matter for a team that automates follow-up:
- You may name the opt-out methods. A caller or sender can designate an exclusive way to revoke consent: an automated voice or key-press opt-out on the call, a reply text using one of the standard words (stop, quit, end, revoke, opt out, cancel or unsubscribe), or a website or phone number set aside for opt-outs. It only counts if each call or text says so clearly.
- Informational and marketing messages are separated. A stop request in reply to an informational message, such as an appointment reminder, may be read as covering only that kind of message. A stop request in reply to a marketing message ends all future marketing calls and texts from that sender.
- A confirmation text is allowed. One text that only confirms the opt-out, with no promotion in it, is presumed fine if it goes out within five minutes.
The ten-business-day limit for honoring a request stays. This is general information, not legal advice; read the rule and talk to counsel about your own forms and messages.
Building a fast reply that respects consent
Before
- A form with a phone field and no consent wording
- Every inquiry gets the same marketing sequence by text
- Opt-outs collected in a shared inbox and removed by hand
- Reminders and offers sent from the same thread with no labels
After
- Consent wording beside the phone field, stored with the date on the contact record
- The first reply answers the inquiry; promotion only goes to people who agreed to it
- STOP and the other standard words end the sequence at once, logged on the record
- Reminders and offers labeled as separate kinds of messages
On the levelpartner.ai platform, a missed call text back answers an unanswered call within seconds, and the calendars and booking feature lets the person pick a time in the same message. Both only work well when the consent is captured where the inquiry starts.
The firm gets 120 inquiries a month. Today the average first reply takes most of a working day, and 1 in 10 inquiries becomes a booked call. Suppose answering within minutes raised that to 1 in 7, about 5 more calls a month. If 1 in 4 calls becomes a client worth €5,000 in first-year fees, that is roughly €6,250 a month of work you were not getting. These are illustrative figures, not a result. Use your own numbers in the ROI calculator.
What this means for your team
For a company with 10 to 250 staff, speed to lead is a system, not a person. Decide the first reply for each channel, put consent wording on every form, and label your messages as informational or marketing before November 25, 2026, so opt-outs land where the new rule expects them.
